Terms & Conditions

Booking, and Methods of Payment – We accept cash and credit cards via PayPal or Venmo. A non-refundable retainer of 50% of the total for order of $500 or greater, and must be made at the time of booking for all custom cake orders. The balance is due 14 days prior to your event. We reserve the right to cancel your order if the balance has not been received within this deadline. No payments made to us will be refunded or transferred, and we will be under no further obligation. For cake orders of $500 or less, payment in full is required upon booking, and is non-refundable and non-transferable. The retainer to book your date on our calendar must be sent to us within five (5) calendar days of declaring your intention to order your cake from us. If the retainer has not been received after five (5) days, the date will re-open at The Butter Cake Studio's discretion. We reserve the right to book another cake order for your date if the retainer is not received within this five-day period. 

Minimum Order and Seasonal Restrictions – A minimum of $1000 is imposed on all custom-designed cakes. This minimum may increase to $1500 during peak season (October through June), at our discretion, and depending on our availability. A minimum of $250 is imposed on all cakes ordered from the Party Cakes range.

Delivery Restrictions - Our cake deliveries are scheduled on a first-come, first-served basis. We do not offer delivery for any cake order of less than $500 during peak season (October through June), not including the cake delivery fee. If your cake order is over $500 and your cake is eligible for delivery during peak season, this is not a guarantee that we will have the capacity to deliver your cake. In these instances, your cake may need to be picked up from the studio instead. We will discuss the options with you based on our availability.

Changes – The initial design phase for custom-designed cakes includes one sketch, and one revision. Once you (the client) have approved your cake design and have received a PDF order confirmation from The Butter Cakes Studio, you may make reasonable changes to the design of your cake up to 3 weeks prior to your event. 

Cancellation Policy – The retainer payment (to secure your cake order on our calendar) is non-refundable. The payment is transferable to another event within one (1) calendar year of our receipt of your retainer payment. If you wish to cancel your order with us outright, we must receive notification of your intent to cancel your order in writing. If we receive an order cancellation request less than four weeks prior to your event date, the balance payment owing on your order is nonetheless due in full.

Wedding cake tasting payments are not refundable and are not transferable if the appointment is canceled less than 24 hours prior to the scheduled time of pickup (in the case of a "to go" tasting pack) or less than 48 hours prior to the scheduled consultation time (in the case of an in-person tasting with the chef). We require payment in full of your tasting fee by 72 hours prior to the scheduled appointment, to give us enough time to prepare your chosen cake flavors. If we do not receive payment for the tasting within this deadline, your appointment will be canceled.

Deposit for Cake Stands – In the event that you choose to use one of our cake stands or pedestals, we require a $100 refundable deposit for each item that is on loan to you. Your deposit will be returned to you if each item is returned to us, clean and unharmed, within seven (7) days of the event. We reserve the right to keep your deposit (or to deduct a reasonable portion of the deposit to cover cleaning or restoration costs) if these conditions are not met. 

Fresh Flowers – If you wish to have fresh flowers arranged on your cake, it is your responsibility to supply the flowers (whether they are self-sourced or ordered through your event florist). In choosing to have fresh flowers arranged on your cake, you acknowledge that fresh flowers are not food products, and may be toxic or contain pesticide/herbicide residues, dirt, insects, and/or other contaminants. If we have been informed prior to the event date that fresh flowers will be supplied for your cake, we will gladly arrange these flowers on your cake for you, upon our arrival on site. However, all responsibility for the freshness, color, overall condition, and cleanliness of the flowers rests with you (and/or the event florist). If the fresh flowers for your cake have not been set aside on or near the cake table (for ease of locating them upon our arrival at your venue), then we reserve the right to set up your cake without fresh flowers.

Sole Provider – For reputation-management and food-safety reasons, all cakes for your event must be supplied by The Butter Cake Studio. If any cake is provided by an individual or company other than The Butter Cake Studio (including groom’s and sheet cakes), we reserve the right to leave your venue without setting up your cake, and all payments made to us will be forfeited. We will dispose of your undelivered cake at our discretion.

Our Obligation – We take our obligation to provide your cake very seriously. However, should an unforeseeable event occur that prevents us from fulfilling our obligation and forces us to cancel our agreement with you, we will refund your payment in full. In addition, if at all possible, we will work with you to find another qualified pastry chef or local bakery to assist you with your cake, and will communicate your specifications to the new baker/designer.

Liability for Mistakes – While we make every effort to provide exactly the flavors, fillings, decorations, sizes, shapes and colors you have requested, the creation of a wedding cake is an art and may be subject to slight variations and/or errors by the creator(s).

Limitation of Liability – The Butter Cake Studio will endeavor to perform its services in a professional manner and provide the best customer experience possible. In the event that our products or services do not meet our high standards, or the client is dissatisfied, we may--at our discretion--refund the amount paid for those products and services. The Butter Cake Studio’s total liability is hereby limited to amounts paid to The Butter Cake Studio for its goods and services. The Butter Cake Studio will not be liable for any special, incidental, punitive, or consequential damages, whether foreseen or unforeseen, regardless of whether liability is based on breach of contract, breach of express or implied warranty, negligence, strict liability, tort, or otherwise.

Post-Setup Precautions – Once the cake assembly/setup is complete at your event venue, The Butter Cake Studio is not responsible for any damage to the cake other than damage that occurs as a result of improper construction/production. If your venue is outdoors, it is your responsibility to take the necessary precautions (shading, level ground, insect netting, wind protection, temperature control, etc.) to ensure that the cake remains intact beyond initial setup. 

Photographs of Your Cake – We reserve the right to take and use our own photos of your cake(s) to use for marketing and promotional purposes without compensation to you. We may also request photographs from your photographer for the same purpose, although we would credit the photographer in our marketing (if the photographer agrees thereto).
